Welcome to Gameonfishing.app (the “App”). These Terms and Conditions (the “Terms”) are a legal agreement between you and David Alan Pratt of 3510 South Road, Ōpunake 4682, New Zealand (“we”, “us”, “our”). They govern your download and use of the App and any related services (together, the “Service”).
Please read these Terms carefully. By downloading, installing, creating an account or using the App, you agree to be bound by them. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to use the App. If you are under 18 (or the age of majority where you live), you may use the App only with the permission and supervision of a parent or guardian, who agrees to these Terms on your behalf. Only an adult may make a purchase or start a subscription.
2. Your account
Some features may require you to create an account. You agree to provide accurate information, keep your login details confidential, and tell us promptly if you suspect unauthorised use. You are responsible for all activity under your account.
3. Licence to use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the App on devices you own or control, for your own non-commercial purposes. You must not copy, modify, reverse engineer, decompile, sell, rent, sublicense or create derivative works of the App, except to the extent the law allows despite this restriction.
4. Subscriptions and in-app purchases
4.1 What we offer
The App offers free features and may offer paid features through in-app purchases, including auto-renewing subscriptions (“Subscriptions”). The name, length, features and price of each Subscription are shown in the App before you buy. Prices include applicable taxes where required by law.
4.2 Billing and auto-renewal
- Payment is charged to your Apple ID account (iOS) or Google Play account (Android) when you confirm your purchase.
- Subscriptions renew automatically for the same period and at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Your account will be charged for renewal within 24 hours before the end of the current period.
- If we offer a free trial or introductory price, it converts to a paid Subscription at the standard price when the trial or introductory period ends, unless you cancel before then. Any unused portion of a free trial is forfeited when you purchase a Subscription, where the store allows.
4.3 Managing and cancelling
You can manage or cancel your Subscription at any time in your store account settings. Cancelling stops future renewals; you keep access until the end of the period you have already paid for.
- iPhone / iPad: Settings > [your name] > Subscriptions, or through the App Store.
- Android: Google Play Store > Profile icon > Payments & subscriptions > Subscriptions.
Deleting the App or your account does not cancel your Subscription. You must cancel through the store.
4.4 Price changes
We may change Subscription prices. We will give notice in the way the store requires. Where the store requires your consent to a price increase, your Subscription will not renew at the new price until you agree.
4.5 Restoring purchases
If you reinstall the App or change devices, you can restore previous purchases using the “Restore Purchases” option (where available) while signed in to the same store account.
5. Refunds and cancellations
All purchases are processed by Apple or Google, not by us. Apple and Google control refunds under their own policies, so refund requests must be made to them: via reportaproblem.apple.com for Apple purchases, or through Google Play’s refund process for Android purchases. Subject to your legal rights (see section 12), we do not offer refunds for partially used Subscription periods.
6. Acceptable use
You agree not to:
- break any law or regulation, including fishing, wildlife, conservation and trespass laws;
- upload or share content that is unlawful, harassing, hateful, obscene, misleading or infringes anyone’s rights;
- post false catch records, or content that promotes illegal fishing, poaching or harm to wildlife or the environment;
- interfere with or disrupt the App, servers or networks, or attempt to gain unauthorised access;
- use bots, scrapers or automated tools to access the App, or harvest data about other users;
- impersonate another person or misrepresent your affiliation;
- use the App for any commercial purpose without our written consent.
7. Your content
You may be able to submit content such as catch logs, photos, notes, locations and comments (“Your Content”). You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, reproduce and process Your Content as needed to operate, secure and improve the Service and, where you choose to share it publicly in the App, to show it to other users.
You confirm that you have the right to submit Your Content and that it does not breach these Terms or anyone’s rights. We may remove content that breaches these Terms or the law, but we are not obliged to monitor content.
Location sharing: If you share fishing spots or locations, other people may be able to see them. Think carefully before sharing sensitive or private locations, including private land.
8. Fishing, safety and the law
The App provides general information and tools for fishing enthusiasts. Information such as weather, tides, maps, species details, size or bag limits and fishing spots is provided for general guidance only and may be inaccurate, incomplete or out of date.
You are solely responsible for your own safety and decisions. Always check local weather and water conditions, wear appropriate safety gear, and follow all applicable laws, licence requirements, size and bag limits, seasonal closures and access rules. Do not rely on the App as your only source of safety or regulatory information, and do not use the App in a way that distracts you from hazards. Fishing, boating and being near water carry inherent risks, and you participate at your own risk.
9. Intellectual property
The App, including its software, design, text, graphics, logos and data (other than Your Content), is owned by or licensed to us and is protected by copyright and other intellectual property laws. Except for the limited licence in section 3, no rights are granted to you. The name “Gameonfishing” and related logos are our marks and may not be used without our written permission.
10. Third-party services
The App may use or link to third-party services (such as Apple, Google, analytics, maps or authentication providers). We do not control and are not responsible for third-party services, and your use of them is subject to their own terms and privacy policies.
11. Privacy
Our Privacy Policy explains how we collect, use and protect your personal information. By using the App, you acknowledge that you have read it.
12. Disclaimers and your legal rights
To the extent permitted by law, the App is provided “as is” and “as available”, and we do not warrant that it will be uninterrupted, error-free, secure or that any information in it is accurate or reliable.
Nothing in these Terms excludes or limits rights you have under consumer protection laws that cannot be excluded, including (for New Zealand consumers) the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, or equivalent laws in your country. If you are acquiring the App for the purposes of a business, the Consumer Guarantees Act 1993 does not apply to the extent permitted by law.
13. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss, or any loss of profit, data, goodwill or opportunity, arising from your use of (or inability to use) the App. To the maximum extent permitted by law, our total liability to you for any claim relating to the App is limited to the amount you paid for the App or Subscription in the 12 months before the claim arose.
Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.
14. Indemnity
To the extent permitted by law, you agree to indemnify us against claims, losses and expenses (including reasonable legal costs) arising from your breach of these Terms, Your Content, or your violation of any law or third-party rights.
15. Suspension and termination
You may stop using the App at any time and may delete your account through the App or by contacting us. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service. On termination, your licence ends and you must stop using the App. Sections that by their nature should survive termination will do so. Termination does not cancel any store Subscription; see section 4.3.
16. Changes to the App and Terms
We may update or change the App, its features and pricing from time to time. We may also update these Terms. If we make material changes, we will notify you in the App or by other reasonable means, and the “Last updated” date above will change. Your continued use of the App after changes take effect means you accept the updated Terms.
17. Additional terms for Apple users
If you download the App from the Apple App Store:
- These Terms are between you and us only, not Apple. We, not Apple, are responsible for the App and its content.
- Your licence is limited to use on Apple-branded products you own or control, as permitted by the App Store Terms of Service (Usage Rules).
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, which will refund the purchase price (if any); Apple has no other warranty obligation for the App.
- We, not Apple, are responsible for addressing any claims relating to the App, including product liability, legal or regulatory compliance, consumer protection and intellectual property infringement claims.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, may enforce them against you.
- You must comply with applicable third-party terms when using the App (for example, your wireless data service agreement).
Apple App Store Terms of Use (EULA)
If you access or use the Gameonfishing.app mobile application through the Apple App Store, your use of the application is also subject to the applicable End User License Agreement (EULA). Unless Gameonfishing.app provides a separate custom End User License Agreement, Apple's Standard Licensed Application End User License Agreement applies to your use of the application downloaded through the Apple App Store.
You can review Apple's Standard End User License Agreement here:
Apple Standard EULA
These Terms are intended to supplement the applicable platform terms and do not override any mandatory rights or protections available to you under applicable law.
18. Additional terms for Google Play users
If you download the App from Google Play, you also agree to the Google Play Terms of Service. Google is not responsible for the App, its content or support, and Google Play’s purchase, billing and refund policies apply to your purchases.
19. Governing law
These Terms are governed by the laws of New Zealand, and the courts of New Zealand have non-exclusive jurisdiction over any dispute. If you are a consumer in another country, you may also have the benefit of mandatory consumer protection laws of your country of residence, and nothing in this section affects those rights.
20. General
- Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us about the App.
- Severability: If any provision is found unenforceable, the rest remains in effect.
- No waiver: Our failure to enforce a right is not a waiver of it.
- Assignment: You may not transfer your rights under these Terms. We may assign ours to a successor to the App.
- Force majeure: We are not liable for failure or delay caused by events beyond our reasonable control.
